Are fangames legal, according to UbiSoft?

Well, I'm asking this cause I'm thinking of some Rayman fangames that I want to make, I can, but, I wonder, will Ubisoft take them down? Has it ever happened that they did do?

They usually allow fangames, but they are more than capable of sending a C&D if they so choose.
Don't let that get to you though, that's not happened here, but I recall that happening to a Sonic fangame.

Making a fangame is probably legal as long as you're not making profit out of it.

This. Look at Rayfan's game for example. It is under development for years and Ubisoft said nothing so far.

This is very, very different depending on countries. For example in Poland you're (or you used to, our law is very fragile) absolutely safe if you can state with certainity that your work is a parody of original one and that it would be hard to understand without the "copied" work. I don't think this specific type of legalizing fanwork exists in other places.
