People like that Nintendo's attorney make me sick. One day in future, I will hopefully have legal battle against Nintendo and expose them to the whole world for what they are. No offense to talented developers, I only hate the scum at Nintendo who do legal stuff and policies since they handle that job poorly.

Go ahead, dawg. Disregard intellectual property like this (nonetheless talented) creator did. Go to court and lose. Then what? You still have to eat.

Oh, and I applaud your statement that you're above laws and rules because it's 2015 and we shouldn't need to care about those anymore. Oh wait...

I never said a statement that I am above the laws. If you follow the video on the part where I talk seriously, I told that I would rationally answer C&D letter and say arguments to attorney why I disagree with their statement and that I would invite him to travel to my place and have a civilized serious court battle.

I said that because it is 2015, copyright law needs to be updated. When original copyright law was made, Video Games, Internet didn't exist. There wasn't digital era. Most of current things online are in grey area and it needs to end. It needs to be finally defined by law what can and what can't be done.

Also, if I was author of this fangame, I could easily win the court case if it happened as soon as I point out the new updated policy Nintendo wrote regarding fan projects that they completely disrespected when C&D letter was sent to this creator. There are also many arguments I would use but I won't talk it all here since it would take forever to write.

Now onto real talk. Lawsuits can take years to be finished. I remember one lawsuit from 2011, it is still not done. Do you think Nintendo would waste money, time and travel cost (if creator is from another country) to sue one individual regarding remaking 1st level of Mario 64 where he earned no profit from it?

Which they will laugh at, totally disregard and reissue their strike the following second. Not the fairest treatment, sure. But that's how big companies respond.

Super Mario is a character and a brand. Both of those can be (and are) subjectted to intellectual property. No need for refreshment on this part.

You could make the argument that is game is not a "fangame" but "plagiarism" due to the fact that it is supposed to be a replica of SM64. Nintendo may have been scared that the project expands and ends up being a full HD replica of SM64, distributed on non-Nintendo platforms for free. You would argue that acquiring a replica for free would encourage you to buy the original, and I would answer that nobody I have ever known fucking does it.

I admit guilty of not particularly liking Fire Emblem, but for the Mother trilogy, maybe us non-japanese peasents could become fans if Nintendo actually released the games outside their comfort zone.

I concur. EarthBound is worth playing, and it's available on eShop.

Heck, you can even play it on emulator.

It's more of a problem for games like Captain Rainbow that seemingly won't ever come out of Japan, actually. Not even on Virtual Console.
(Seriously, i've been wanting to play this game for like AGES. Someone did start a translation, but it doesn't look like it's going smoothly to me)

If they want to laugh, they can laugh how much they want, but the only way to keep it down if person denies C&D letter is if they win court case. No company ever dared to sue individual for fangame and there is a reason for why.

Unauthorized =/= illegal. Words by Attorney Patrick McKay
Just because someone used Mario IP without permission doesn't automatically mean they violated copyright law. Adsolution is making ROTD and that game is infringing 0%
The way how and on what way somone's IP is used is important. If using someone's IP without permission is automatically infringing, then lawsuits wouldn't be long processes and instead they will be over within a second.

Plagiarism is the "wrongful appropriation" and "stealing and publication" of another author's "language, thoughts, ideas, or expressions" and the representation of them as one's own original work
The HD Remake maker never said that Mario 64 is his original work and he did aknowledge the original game made by Nintendo , therfore argument for plagiarism is not valid. If Nintendo was scared of this becomming full HD replica and damaging the sales of the original game, then they should have follow progress of this for a few months and if huge progress was made, they should propose to adapt the remake for Wii U. Capcom did same thing for fangame Street Fighter X Mega Man.

Nintendo has right to fear of that, however they have 0 evidence that author ever intended to replicate the whole game and put it online for free. It can be argued that this is just a small tribute to Mario 64 and showing creative vision of alrady existing game. When analyzing four factors of fair use, the last factor is called "The effect of the use upon the potential market for or value of the copyrighted work."
There was no potential market for a small demo, if anything, playing 1 level could encourage people to buy game to play more levels. It is more than clear that the lawsuit case regarding this demo is something Nintendo cannot win in any way.

Now if they sued him and he already released full replica for free online, that is completely other case.

Uh yeah, changing subjects real quic, I've decided to go with Yoshi's New Island for the Premium Gift that Club Nintendo is offering. I'll get New Super Mario Bros. 2 soon enough. I still have 200 coins but I haven't gotten a clue on what to get.

And also the price for the DLC Mii packs are really good!

Hopefully the leak inspires some more Rayman votes, I think he might have a legit chance.

The people having to sort these votes out are probably getting some hilarious shit. Imagine the masses of "ADD HATSUNE MIKU"

Both games are pretty big turds. New Island has really uninspired level design and the soundtrack is very hit and miss. Might as well purchase the Yoshi's Island DS they just put on VR.

Sega never takes down fangames. Period.

Also, how can we be sure that some fangames we have today the companies didn't try to take down in past? I can bet that Mother 4 (which is unauthorized sequel and that is not quite same like fangame and many companies hate unauthorized sequels even more)was tried to be taken down by Nintendo but the dev team just never told that anyone and ignored Nintendo's Cease and Desist letter which is something every fangame maker should do. I also remember case of one Pokemon site that Nintendo tried to take down and creator laughed about it and told everyone Nintendo requested that but he never took website down.
