I'm pretty sure that's the case at least. If an 18 year old and 16 year old get jiggy then it's technically statutory rape, but honestly I think the law is more lenient and such a small age difference wouldn't be a problem.

The system is dumb. It implies some sort of magical Cindarella-esque transformation happens when the child hits 18 and assumes some higher level of responsibility. I remember watching an episode of that American Dateline NBC (or whatever it's called) where they seized a 21-year-old for attempting to meet a 15-year-old, and while that may not be wholly appropriate, it's hella better than a 55-year-old meeting up with a 13-year-old. There should be some sort of age gap system instead.

Pretty much, instead the US opts for constantly forcing some 18 year olds who got it on with 16 year olds to go through the most retarded long process only to go "oh yeah we don't actually sentence people in 95% of these cases" every time. I've even seen a situation where the judge refused to have common sense so they handed the case over to another who would speak the guy free - why even have the fucking case then?
